Family Law

When relationships break down, the uncertainty and worry can be overwhelming. And while we do not hold a magic wand, we do have the knowledge and skills to provide you with peace of mind that things will get better, and your interests are being represented.

So whether you are considering your options, or have made a decision and are looking to implement it, contact us to assist you in ensuring you can move on to the next chapter in your life in the the best position and the shortest time possible.

Matrimonial Property Settlements

A matrimonial property settlement determines which assets and liabilities are retained by each party to the relationship. While the Court's assistance is sometimes required, our goal at Craig McKay Legal is to obtain a just and equitable settlement for you by way of Consent Orders through negotiation on your behalf with your ex-spouse.

If you would like to discuss what a just and equitable settlement would look like for you, or simply would like to get an idea of your entitlements, take advantage of our no obligation telephone consult here

De Facto Property Settlements

If you have lived in a de facto relationship for two years or more, you are similarly entitled to a property settlement. Again, our goal is to achieve a negotiated settlement that relects your entitlements.

If you would like to discuss what a just and equitable settlement would look like for you, or simply would like to get an idea of your entitlements, take advantage of our no obligation telephone consult here

Binding Financial Agreements

Often referred to as a 'pre-nup', a Binding Financial Agreement is a mechanism by which the parties to a relationship can determine what they believe is a just and equitable division of the relationship assets, whether prior, during or after their relationship, without the assistance (or oversight) of the Court. They are essential for parties who are in a relationship where a significant disparity in wealth has been brought into the relationship.

If you would like to discuss whether a Binding Financial Agrement is right for your circumstances, take advantage of our no obligation telephone consult here

Divorce

Once married couples have been separated for 12 months, they can obtain a divorce, without the need to go to Court. With our assistance the process is non-contentious and can be handled on your behalf.
